Portal or People - Accident Claims Process

CLAIM glitches and other problems with the new electronic process for Personal Injury claims could mean claimants are still better off using a qualified solicitor.

The electronic claims portal, which was introduced in 2010, was designed to speed up and cut the cost of processing low value Road Traffic Accident (RTA) claims. This portal is used where compensation is valued between £1,000 and £25,000.

The portal sends Claim Notification Forms directly to at-fault drivers’ insurance companies allowing claims to be made easily and cost effectively, saving time and money. In 2013, other types of accident claims such as accidents at work, industrial disease and public liability were, also, included in the scheme.

Six Months On: Your claim could “exit the portal and revert to the old rules.”

The latest reforms to the electronic portal service, termed the “Jackson Reforms” (1 April 2013), have now been in place for over six months, enabling solicitors and claims management companies to evaluate the success of the changes. Joanne Astridge, Personal Injury Specialist at Molesworths said:

“Despite aims to cut costs and speed up claims, the new process is not without many problems and drawbacks. Most public liability claims fall out of the portal process as the strict time limits, within which insurance companies must admit liability and make settlement offers, are often missed. Also, if liability is denied, for any reason, claims could exit the portal and revert to the old rules.”
